The Uniform Commercial Code allows a creditor to notify other creditors about a debtor’s assets that are used as collateral for a secured transaction by filing a financing statement with particular filing offices.
Effective July 1, 2001 the laws relating to lien filings have been changed. Town and city clerks will no longer receive filings or changes for UCC’s. The only new filings to be accepted by the town or city clerks are federal tax liens, state tax liens, hospital liens, and town/city tax liens on manufactured housing. Changes to anything other than a UCC will be accepted, as will terminations for UCC’s on file with the town or city clerk.
Older 5x8 forms are no longer acceptable except for termination of UCC’s filed prior to June 1, 2000. Filings made on older forms will not be processed and will be returned.
Searches at the town/city level now require a full disclosure of information, meaning that all lien files will be searched, not just UCC’s when conducting a search. The fees for searches have been increased to $10 per search and $1 per page copied.
